Terms and Conditions

These Terms & Conditions apply unless superseded by an executed Master Service Agreement (MSA), National Account Agreement, or other written contract between Atlas Sign Industries and the customer.

  1. Payment Terms

Unless otherwise agreed in writing, a 50% deposit is required before production begins. The remaining balance is due upon completion of installation or prior to shipment, as applicable.

Past due invoices are subject to a finance charge of 1.5% per month (18% annually) or the maximum rate permitted by applicable law.

Atlas Sign Industries reserves the right to suspend production, delivery, or installation on accounts with outstanding balances.

  1. Ownership of Materials

All signs, products, materials, equipment, and services provided by Atlas Sign Industries remain the property of Atlas Sign Industries until payment has been received in full.

In the event of non-payment, Atlas Sign Industries reserves the right, where permitted by law, to remove, recover, or repossess installed products. The customer is responsible for all costs associated with removal, storage, and reinstallation.

  1. Taxes

Applicable federal, state, and local taxes will be added where required by law. Tax rates are subject to change based on applicable jurisdiction.

  1. Electrical Requirements

Unless specifically included in the proposal, the customer is responsible for providing all required electrical service, wiring, outlets, disconnects, and connections necessary for the installation.

Electrical service must be available within five (5) feet of the sign location prior to the scheduled installation date. Additional charges may apply if electrical requirements have not been completed before installation.

Time clocks and electrical controls are not included unless specifically identified in the proposal.

  1. Installation & Site Conditions

Installation pricing is based on normal site conditions. Additional charges may apply if unforeseen conditions are encountered, including but not limited to:

  • Rock or unsuitable soil
  • Underground utilities or obstructions
  • Limited site access
  • Structural conditions
  • Equipment restrictions
  • Other unforeseen field conditions
  1. Product Specifications

Unless otherwise specified, cabinet signs are manufactured using aluminum construction with finishes identified in the approved project specifications.

Due to normal manufacturing processes, slight variations in paint, vinyl, acrylic, LEDs, plastics, and other materials may occur and shall not be considered defects.

  1. Delivery & Installation

Estimated production, shipping, and installation dates are provided in good faith but are approximate only.

Atlas Sign Industries shall not be liable for delays resulting from permitting agencies, utilities, weather, freight carriers, material shortages, customer delays, force majeure events, or other circumstances beyond its reasonable control.

  1. Project Changes, Delays & Additional Charges

Additional charges may apply for change orders, customer-requested modifications, project delays, storage, rescheduled installations, return trips, expedited requests, or other circumstances that affect the original scope or schedule of work.

Applicable charges will be determined based on the specific project, proposal, customer agreement, master service agreement, or applicable service contract.

  1. Cancellations

Because all signage is custom manufactured, accepted orders may not be canceled without written approval from Atlas Sign Industries.

If a cancellation is approved, the customer agrees to pay for all labor performed, engineering, permitting, materials purchased, production costs, subcontractor expenses, and applicable overhead incurred through the date written notice of cancellation is received.

  1. Warranty

Atlas Sign Industries warrants its workmanship for one (1) year from the date of installation unless otherwise stated in writing.

Manufacturer warranties for LEDs, power supplies, transformers, electronics, or other third-party components are limited to the warranty provided by the original manufacturer.

This warranty does not cover damage resulting from:

  • Vandalism
  • Accidents
  • Acts of God
  • Improper maintenance
  • Unauthorized modifications
  • Electrical surges
  • Abuse or misuse
  • Normal wear and tear

Atlas Sign Industries’ liability under this warranty is limited solely to the repair or replacement of defective workmanship or materials.

  1. Code Compliance

Signs are manufactured and installed in accordance with approved engineering, applicable building codes, and permit requirements where required.

  1. Limitation of Liability

Atlas Sign Industries shall not be liable for incidental, indirect, special, consequential, or punitive damages arising from any project, including but not limited to lost profits, business interruption, or loss of use.

Atlas Sign Industries’ total liability shall not exceed the amount paid by the customer for the products or services giving rise to the claim.

  1. Force Majeure

Atlas Sign Industries shall not be responsible for delays or failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, hurricanes, floods, fire, labor disputes, material shortages, transportation delays, government actions, utility interruptions, pandemics, or other unforeseen events.

  1. Entire Agreement

These Terms & Conditions, together with the applicable proposal, quotation, purchase order acceptance, or service agreement, constitute the entire agreement between Atlas Sign Industries and the customer and supersede all prior discussions, negotiations, or understandings regarding the project.
